1. Terms of Use

By accessing this website, purchasing our curated African-inspired, Italian-crafted garments, or engaging with our digital platform, you fully accept and agree to comply with these terms. If you disagree with any segment of these conditions, you must discontinue using our services immediately.

2. Intellectual Property Rights

Mikali Sapani represents a visual synthesis of African heritage and refined Italian execution. Every item displayed, including but not limited to clothing designs, patterns, text descriptions, digital logos, brand imagery, vector graphs, video sequences, and software code, is the exclusive intellectual property of Mikali Sapani and protected by international copyright, trademark, and trade dress regulations.

You are strictly prohibited from copying, distributing, modifying, republishing, or commercially utilizing any portion of our visual designs, patterns, and editorial assets without the explicit, written, prior authorization of our creative directors. Unapproved copying of our designs constitutes copyright infringement and will be legally prosecuted.

3. User Accounts & Registration

If you register an account to streamline your luxury purchase history, you agree to keep your credentials strictly confidential and accept full accountability for all actions performed under your account profile.

We reserve the absolute right to suspend, terminate, or delete user accounts if we detect fraudulent activity, payment discrepancies, systemic abuse of our services, or breach of these terms.

4. Commercial Sales & Global Deliveries

Ordering items from Mikali Sapani constitutes a binding purchase offer. All orders are subject to stock availability and pricing verification.

A. Pricing & Customs Duties

Prices are listed in local currencies (e.g. EUR, USD, GBP) as specified on our checkout panels. For international deliveries, the customer acts as the importer of record and is solely responsible for paying any local customs duties, VAT, or import clearance fees levied by your home country.

B. EU Consumer Right of Withdrawal

In compliance with the European Union Consumer Rights Directive, EU-based consumers have a right to withdraw from their purchase contract and return their items within 14 calendar days of delivery, without justifying their reason.

To exercise this right, returned items must be in pristine, unworn condition, complete with original security tags, luxury packaging, and documentation. Custom-tailored items, made-to-measure garments, and sanitary-sealed articles are excluded from this 14-day right of withdrawal.

5. Colors, Sizing, and Descriptions

We aim to display the textures, draping, and colors of our garments with maximum precision on our storefront. However:

• Color Discrepancies: Due to screen calibration differences, display technologies, and device rendering, actual color hues may vary slightly from how they look on your screen.
• Sizing Dimensions: Sizing details are provided as helpful indicators. If you are uncertain about sizing fits, we highly encourage getting in touch with our customer advisors before placing an order.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Mikali Sapani shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of, or inability to use, our storefront, purchase our products, or rely on technical data on the site.

We do not guarantee that our digital storefront will remain completely free of temporary outages, server bugs, or service interruptions.

7. Governing Law & Dispute Resolution

These terms are governed by and construed in accordance with standard European eCommerce laws and the laws of Italy/EU.

If you reside in the EU, you also enjoy the protection of mandatory consumer regulations in your home country. Any dispute arising under these conditions will be subject to the exclusive jurisdiction of the courts corresponding to Mikali Sapani's legal headquarters, or the consumer's local residence if in the EU.
